Tesco Internet Phone product Terms & Conditions

Please read these Product Terms and Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco Phone Shop makes the products available to you via the tescointernetphone.com website (Tesco Internet Phones site).

Prices and product information

 

The prices payable for the items that you order are clearly set out on the Tesco Internet Phones site.

Every effort is made to ensure that prices shown on the Tesco Internet Phones site are correct. If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item concerned. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price.

All prices are expressed inclusive of any VAT payable unless otherwise stated.

The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which are displayed in the 'Help' section of the Tesco Internet Phones site.

Product information is included on the Tesco Internet Phones site and if there is anything which you do not understand, or if you want information, please see the compatibility section in the ‘Help’ section of the Tesco Internet Phones site.

Bulk buy policy

 

To ensure availability of all our products, customers are limited to a maximum of six items per order.

Availability

 

If items are not in stock an ‘out of stock’ flag, with an ‘e-mail me when this item becomes available’ option, will be shown. If for any other reason beyond our reasonable control, we are unable to supply a particular item we will not be liable to you except to ensure that you are not charged for that item.

Acceptance

 

Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch the goods to you, at which point a contract will be made between us. At any point up until then you may cancel your order or we may decline to supply the goods to you.

By placing an order you are authorising us to accept signature from another person if the recipient is not present at the time of delivery.

Where items are dispatched separately, then our acceptance of the order in respect of each item takes place when that item is despatched, and you will be charged for each item when it is dispatched.

Delivery

 

Delivery will be made to the address(es) specified by you on the completed order form (up to a maximum of two addresses).

We are able to deliver items to England, Wales, Scotland and Northern Ireland.  We are also able to deliver to destinations outside the United Kingdom; please see the ‘Help’ section for a list of these countries.

Delivery to the United Kingdom

Orders of one or two items to the same address will be delivered by 1st Class Royal Mail. Orders of three or more items to the same address will be delivered by Parcel Force Next Day Delivery which will have to be signed for. If the recipient is unavailable when they call Parcel Force will leave a card explaining how to pick up the items.

For orders placed before 3pm we aim to have a same day despatch and deliver the order within 48 hours (except for weekends and bank holidays) and for orders placed after 3pm we aim to have next day despatch and deliver the order within 48 hours of despatch (except for weekends and bank holidays) and in any event we aim to deliver within 1 to 5 working days.

Delivery Outside the United Kingdom

You can choose whether to have items delivered by 1st Class Royal Mail or by courier, although orders of three or more items to the same address will be delivered by courier.  Estimated delivery times are displayed in the ‘Help’ section of the Tesco Internet Phones site.

Whilst we make every effort to deliver all goods to destinations in the United Kingdom and the rest of Europe within 30 days of the date of the order, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.  Deliveries outside Europe may take even longer.

Ownership of the item(s) will not pass to you until such time as we have received payment of the purchase price in full. Risk of damage to or loss of the item shall pass to you at the time of delivery of the item(s).

Free gifts / promotional items

 

Free gifts that are given away in conjunction with a purchase may be despatched to you separately and delivery times may vary.

If you change your mind and return your item under the returns policy in section 8 below (if it is applicable to you) you must also return any free gift/promotional item (including call time vouchers) received as a result of that order. Free gifts/promotional items are subject to availability and terms and conditions as set out on the Tesco Internet Phones site.

Cancellation

 

If you received the item as a gift and live in Europe, you have the right to cancel your order at any time after you place it up to 28 days from of the date the item is delivered.  (We are sorry, but this right does not apply to gifts received outside of Europe.)Please Contact Us to do so.

If the item has not been despatched we will cancel the order and we will not take payment.

If the item has been despatched by Parcel Force or other courier the recipient can refuse to sign for the delivery so that the goods are returned to us and we will refund the price paid to the payment card; alternatively if the item has been despatched by Royal Mail Next Day Delivery and/or the recipient has already taken delivery please follow the procedure under ‘I've changed my mind and want to organise a return & refund’ in section 8 below.

Returns

 

We hope you are happy with your Tesco Phone Shop order, however should you wish to return any item(s) you can do so as explained below (if applicable to you).

(Please note you cannot return items ordered from the Tesco Internet Phones site to Tesco retail stores.)

I've changed my mind and want to organise a return & refund

If you received the item as a gift and live in Europe, you can change your mind and tell us that you would like to return items within 28 days of receipt of the item.  (We are sorry, but this right does not apply to an item received as a gift outside of Europe.)

To arrange the return of an item please Contact Us. If you received the item as a gift and you live in Europe, you can also Contact Us.  Alternatively, you can arrange for the purchaser to contact us directly if this is easier for you.

Addressed return packaging will be provided by us to recipients who live in the United Kingdom.  If you are returning the item from another European country, we recommend you use a postal method that includes insurance for the item and allows you to track the item.  So that we can sell the item again, you must return the item in its original condition, including any accessories, vouchers and free promotional items. When you return the item please remember to quote the returns reference number we have given you.  We will remit a full refund of the price paid back onto the payment card within 30 days of notice of cancellation to us. We will refund the delivery charges unless the whole order is not being returned (in which case we will refund any delivery charges that would not otherwise have been payable).

If the item is not returned within 28 days of the date receipt of the return packaging (in the case of the United Kingdom) or 30 days of your cancellation (in the case of other European countries), we will make a charge in respect of the cost of recovering (or attempting to recover) the item.

If the item is not returned after our reasonable attempts to recover it, the recipient will be deemed to have accepted the goods, at which point a new purchase contract will be made and the purchaser will be charged for the order at the price set out on the Tesco Internet Phones site. If the credit voucher is not returned or is returned with the scratch panel removed in any way, then we cannot use the voucher with another customer and so will charge the purchaser for the value of the voucher.

(Please note that Clubcard points will not be awarded for returned items.)

There's a fault with the item

If the item becomes faulty please Contact Us. If the fault has occurred within the 12 month warranty period, the recipient should return the item to us and we will arrange for a replacement or refund. If the fault is caused by accident, misuse, negligence or abuse of the item, it will not be covered by any manufacturers’ 12 month warranty and the recipient will not be able to get a replacement or refund.

Nothing in these Product Terms and Conditions shall affect your statutory rights relating to faulty goods or services provided. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.

Payments

 

You can pay by any Mastercard or Visa credit card, Maestro, Switch or Delta debit card and Solo card which has a billing address in the United Kingdom. We do not currently accept Visa Electron cards. All payments will be in Pounds Sterling.

Your credit/debit card details will be encrypted to minimize the possibility of unauthorised access or disclosure.

Authority for payment must be given at the time of order. You will not be charged for items until they are despatched.

The cost of your purchase includes a 51p or 1.48% transaction fee, whichever is the greater, that is payable to Barclays Merchant Services.

General

 

Except as expressly set out in these Product Terms and Conditions, all use of your personal information will be made in accordance with our Privacy Policy.

We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

These Product Terms & Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.
